Dear All,
Please help me with compliance issue of Punjab Labour Welfare Fund Act 1965. I want to know that in sec 7a of act rate of contribution to fund by employer and employee per month is given, is it applicable to punjab and haryana both, and if possible give sec no of act specifying its levy in punjab state.

Dear Divya, Yes, it is applicable to Haryana & Punjab both. I m not able to confirm you the section right now as i don’t have the act with me.

I have an PWLF act with me which i am attaching,
Kindly have a look and guide me it is for state of haryana only or it is also for punjab?
If there is seprate act please let me know where to get act for the Punjab as it is very serious compliance issue in the organisation I am doing audit as the organisation is quoting this actto say punjab labour welfare fund act does not require monthly contribution from employee and employer and said act is only for haryana state.
Your help in matter will be highly acknowledged.

Dear Divya Batra,

This is for your information that Punjab Labour Welfare Fund Act, 1965 is applicable to States of Haryana, Punjab & UT Chandigarh. Both the States are making amendment in this Act from time to time & we then call that Act as Punjab Labour Welfare Act, 1965 as applicable to that particular State. In my considered view this attachment has been taken by you from the Haryana Labour Department site. For Punjab Labour Welfare Fund Act as applicable to the State of Punjab you can also take the help of Punjab Labour Department site. What I have observed is that amendment to this effect has not been made by the Punjab Govt. Moreover to be on safer you may verify this fact from the nearest Labour Office or office of L C, Punjab. We are not to make any deduction in head LWF contribution as the Punjab Govt. yet have not yet made any amendment to this effect.

Dear Divya,
After Giving my above reply this came to my mind that even though I could not visualize the the amendment regarding provision of contribution in this Punjab LW F Act, 1965 as applicable to State of Punjab but the members of this citehr & publication of rate of contribution as shown in 'Labour Law Reporter' July,2009 edition shows that we are to deduct Rs.1/- pm as contribution from the wages of the employees & Rs 2/- pm is to be given by the employer. Therefore, it is advisable to verify this fact from the Punjab Labour Deptt. Payment is to be made half yearly i.e. April to Sept. & Oct. to March. Thus the Punjab Govt. must have issued the notification to the effect.

Dear All,
I have contacted the Punjab Labour Welfare dept , they have actually issued a notification in Sep 2006, regarding monthly contribution to fund by employer and employee so information of Labour Law reporter is correct and notification is not available presently online but can be had from Dept, Office. The neccesary changes will be uploaded soon by dept so there will be no confusion like I had.

Can you suggest if we need to submit LWF in each and every state where our associates work or will it be according to the location of our corporate office i.e we have to submit the return in the respective state where our corporate office is located.

Dear Seniors,
Have one querry, our office is located in Delhi and we have some employees who are working in Gurgaon. We have not registered with Haryana Labour, We have already remitted the LWF for these employees in Delhi as salaries are paid out from there. Kindly let me know whether this is correct or we need to remit the LWF in Haryana and in case we need to remit it in Haryana, how can we do that as we have no registered place there.

Labour Welfare Fund contributions are state subject, and the same is applicable and payable according to the state in which employees are working to avail the benefit of labour welfare scheme in that particular states. Like in Haryana there are number beneficial scheme death compenation 1lac, bicycle etc by labour welfare department.
So you need to submit the contribution of employee working in Gurgaon according to the contribution applicable in Haryana at Welfare Commissioner Chandigarh.
though that require having S&E registration, or CLRA license if employee working under Contract.

can an employee get rs. 31000/ from labor welfare fund organization of punjab who is contributed and member of lwf of punjab for his daughter's marriage. If yes sand me a application form or performs to apply for the same.

its is a good piece of information
i have a query with regard to LWF,
1. How will be the employees aware of this benefit, mean how will they claim
2. any law which state that the employer should make them aware of the fund so that the labour can take benefit
3. what if the facility have ESCI and PF still they need to pay under labour fund
