Esi applicability queries - urgent
Dear all our site is in construction and i have 12 employees on role and as per esi applicability if any organization having more than 10 employees and power using construction site then esi is applicable but when i approached esi office they have denied for registration stating the following reasons. please clarify if they are correct or not. 1. our plant has not come into production and our plant is still in construction. is it necessary to get trial production/ production for esi registration. 2. also he explains that unless 10 employees are esi applicable then only esi registration can be done. if so if i have 2 to 3 employees applicable for esi then the registration is possible or not. please clarify the two doubts at the earliest. regards dev

Dear sir/madam i am so confused for esi. where esi is applicable and where it is not. if not applicable why it is not applicable according to the act. as i am working in construction co and we are not following esi just knowing the fact that where bocw act is applicable and no need to follow the esi. i am not totally aware wages definition in pf act and diff between pf esi and wc act. hence you all are requested to brief me about the above i shall be highly grateful to you. thanking you regards gaurav srivastav cont. 8016088257

Dear seniors iam working in an organisation there we have a manpower contractors and they are having there own pf & esi nos. and there are paying the amount monthly for pf & esi. a worker is working more than 2 yrs under this manpower contract and he wants to know whether they are paying pf for him so he get the pf no. from the contractor. now keeping this pf no. can we check in online whether the pf no. is belongs to that person for that what to do. pls tell me. thanks suresh.k

Dear sir in view of phasewise lockdown and relaxations the appropriate governments are allowing the industries to run with less manpower onrolls and contract in green / orange zones. if the local administration allows to run the industry with 33 manpower what is the legality on this matter as mentioned below: 1 out of 1000 manpower we can allow 333 manpower for duty. what about the payment of pf / esi contributions for 637 manpower? 2 how many manpower to be shown for generation of pf / esi challan? 3 what is the liability of employer to pay salaries / wages for 637 manpower as they have not worked at work place or work from home? 4 what is the impact of nonworking mandays in lockdown while calculating annual leaves annual bonus and gratuity? kindly clarify the above points. regards krishna kumar
