Hi
can any one tell me the provision for those kind of employees we have employed on Trail basis. What is the provision / legal obligation for these employees under Factories Act, Workman Compensation Act, or Standing Order or any other revelent Acts considering large manufacturing business unit.
Please suggest your views

You will copme across with following categories of employees
1. Trainees
They are the people who are trained to do a particvular job
2. Probationers
They are the employees on Trial basis. Probationary period is restricted to 6 months under the model standing orders act and extension is restricted to three months each twice. you need to examine this in the Model Standing Orders of your State
3, Confirmed workmen
These probationers are then confirmed after successful completion of Probationary period

Thanks Mr. Sivasankaran,
Its really useful for me. But still the question is unanswered. Actually we want to employed few workers on trail basis and we dont want to give them any thing more except their wages / salary untill they complete their trail. So is their any legal problem if we go for this ?
please suggest me

Legally you need to give
If you do not want to give, there are methods . You need to consult a labour consultant in your area and follow his advices
But I would strongly recommend you to adhere to law That is a basic requirement and as HR professionals we have a duty to perform.
By evading law, we achieve nothing.

Dear Sharma,
I think employment on retainership will best suit to you.
You have to pay only the amount as per retaianership agreement.
If you find any suitable candidate/s from this employment, you can regularise them after closure of /by pre-closing the agreement.

Hello Dear,
Retainership is always a good option for us but it is restricted for certain professional like Doctor, HR etc.. but we cant hire them for maufacturing process and that is a problem for us. What we want is almost clear so please give your ideas on this.
