Hi Seniors,
I want your advice on employees leaving organisation with out prior notice/ without servicing a minimum notice period.
Please advice if any legal action can be taken on absconding employees. What is the procedure and how successful it is.

B4 concentrating on legal action against "absconding employees", kindly study the reason y r they leaving ur organization. Try and execute various measures to prevent "absconding". PREVENTION IS BETTER THAN CURE. Its nothing but ATTRITION (this is my advice, if u don;t like kindly ignore it)

The Legal remedy is to file a civil suit for damages against the absconding employees. the claim should be restricted to the amount mentioned in the "service agreement" entered with the concerned employee. In the agreement if damages amount is mentioned, the same has to be calculated on the days required to work before getting relieved (notice period).

Filing of civil suit will work out properly provided that if you know exactly where the "absconding employee" is residing and whether court summon could be served on him? and in the event of favorable order from the court of law, you should have details of properties held by the "absconding employee" for the purpoer of recover of damages as ordered by court. If recovery is not possible then the "favorable order" of court will only on paper and of no practical use. Calculate the cost involved initiation of legal action.

There could be several reasons. In my opinion following few are top listed
1. non-recognozition of employees work or talent
2. Imporer allotment of work ie.,alloting work to employee which he not capable to do.
3. Improper Human Resource Mgmt.
4. No happy salary
5. Long working hours
6. Improper work time
7. long distance to work from residence.
8. Non distribution work to employee or no work to distribute or ignoring employee or alloting work only particular employee.
9. Retaining a employee who is not interested to work.

Why are you bent on taking legal action ????
Can't you make your organization such that no employees would like to leave it ??? But obviously it is a VERY difficult task !!
Simplest option is to hunt down "absconding employees" and take legal action. Try to hire a "detective agency" for this useless task, which has no value.
In fact you can hire me, for these activities. Considering the kind of organization yours is, I will have my hands full. May be, I"ll have to recruit few more staff under me for this task (still it"ll be cheaper than outsourcing it to reputed detective agencies).
You can assign the designation as Chief HRO (Human Recovery Office).
