Maternity benefit act - whether we have to consider those leaves for calculation of gratuity or not?
Kindly clarify my doubt on gratuity payment calculation when an employee availed maternity leave and left the organisation after 5 yrs and the period of maternity leave is within the period of 5 years whether we have to consider those leaves for calculation of gratuity or not. i think it is to be considered due to a privilege as the same is provided by the act for the female employees? please give your comments

: hi if any one who have the nowladge of leave calculation metiod as per uae labour law suppose a employee sign the labour contract for 36 month and he wish to take the leave three time or entitle 3 month leave salary.so he will be work 33 month and 3 month leave and first leave calculation jan08 to dec08 jan09 to 31st jan 09 vacation then joing 1 feb09 and plan next vacation 1st jan2010 to 31st jan2010 vacation so we calculate his next leave jan09 to dec09 means last holidays period included in next leave calculation period or not. reply me back or e.mail me on mohdamir100hotmail.com"mohdamir100hotmail.com
Will gratuity calculation include maternity leave of 7 months
Hi all we have an employee she joined us worked for 4 years then went for maternity leave for 7 months 3 months full paid & rest of the days were without pay then she came back worked for another 2 years. query is 1. what will be her total service to be taken for gratuity calculation 2. can we exclude her 4 months of without pay period from total service period for gratuity calculation 3. general question if anybody takes a one years continue maternity leave and comes back on duty what will be gratuity treatment for that case?

Leave calculation in full & final settlement
Dear all please solve my problem as below; one person who has joined in organisation was drawing salary and i had given him leave benifit since from his joining. now he has left the organisation before completing his six month probation period. my question is can i work his leave balance in full and final settlement and deduct 30 days in leau of notice period not given because i had given him the benifit of privilage leave or shall i recover the privelage leave already given to him during his tenure period which is not possible now or shall i forfit his leave working in full and final settlement and show the working as his inellligible for leave encash benifit. please help regards kishore rathod
