Retrenchment of managerial level employee
We need to retrenchment a dgm level employee who has been working with us for the last 6 years at monthly salary of 26k. whether there is any retrenchment payment the company need to pay? from my understanding the industrial disputes act 1947 does not apply and no retrenchment payment is required to pay. we only have to give proper notice according the employment contract or payment in lieu to notice to the employee right? hence we are obliged to pay the gratuity payment and payment in lieu of notice. whether my opinion is correct? thanks
Payment of notice period salary to new joiner
We are in the process of appointing an employee since the new joiner has to give three months notice to his previous employer we have agreed to compensate the new joiner with notice period and gratuity. i need to know how do we pay that amount to him i.e. covering letter stating the purpose of payment and how to account this transaction whether as signing amount or compensation towards notice period. should we ask for proof of recovery / non payment by last employer? kindly revert.
Payment in lieu of notice period dispute - bank reserves the right to not accept the payment
Currently i am working with a bank and i have got a better opportunity but i am bound to serve 3 months notice period which is not possible. in my offer letter it is mentioned that the bank reserves the right to not accept the payment in lieu of the notice period and at its sole discretion it may force to complete the notice period. can anybody help with this situation as to what should be my next course of action?
Notice to contractor to recovery of money
Dear sir anybody pl. help me we have deplyoed subcontractors in our different sites there are two such contractrors having same name agency and our a/c. department transfer the payment amount two lacs a contractor a but that payment should have ttransferred to another contractor b. we have contacted to contractor bto asking our payment but he is not responding in this regards and his cotract has been completed. hence pl. get me know to recover that payment and pl. send me any kind of format of notice in this regards. with regards anil pandey
Notice period - the company will decide what to take (either payment or service) - is there any act or clause?
Dear all i want to ask one question regarding the notice period one of my friends is working in a company and has resigned from his services. as per the appointment letter he either has to serve the notice period of 90 days or will have to pay a notice pay payment. but the company will decide what to take either payment or service. now my friend is ready to pay the notice period but the company is not ready to take money and forcing him to serve the notice period. is there any act or clause which deals with the notice period? regards amit nikam
Difference between notice period waiver and notice period buyout
My appointment letter says any shortfall in notice period can be adjusted in lieu of payment however new policy on notice period says notice period cant be waived off.does that mean notice period can not be bought out
