I'm new to this site and have found some very interesting threads. I have an urgent request related to PF and your direct replies would be appreciated. I've tried locating the information in this forum but could not find it.

The problem...

Because of family reasons I am resigning from my current job and would only start looking for a new one sometime next year. I would like to withdraw my PF during the period. I know that you are required to submit a form alongwith an affidavit confirming that you have been without a job after a period of 60 days from the date of relieving of service.

Please confirm the following:

a) Is the last employer required to sign the required form ? (From my understanding, there is no requirement as the PF is mine and they have absolutely no say in the withdrawl after a relieving of duties)

b) Are there any other formalities that need to be completed ?

If the last employer can sign then there wont be much problems. Else you should get it signed by some Govt officer or MLA or MP. Even PF commissioner can sign onbehalf. More over you should know other details like your contribution & PF number.
Else U can wait till U get another job & U can transfer the same.

Hello Jeeva,
Many thanks for your quick response. I need to withdraw the PF and I have all the relevant details. What is the logic behind anybody else required to sign the form. The PF department needs a confirmation that I am not working anywhere and the is satisfied by the affidavit. The previous employer can only confirm that I'm no longer in service with them. That can be confirmed by two things:
a) There is relieving letter
b) There are no further additions to the account after a given date. This is verifiable by the PF Authority themselves.

First can you pez tell ur name.

As per PF dept. rules it clearly says either employer has to sign or any gazetted officer has to sign for the same. Else you can consult the PF commissioner itself. Even he is in the same rank so he might help you in this case.

We cant question about the logics they only tell as it is the rule & has to be followed.

Do you know that what was your monthly contribution & employer contribution for the same period (Which is as per form 3A). Even that details for last financial year also has to be filled. If you know those details just fill it meet the commissioner.

For them no need of relieving letter. Once the employee leaves the organisation the employer will be updating the relevant documents to the PF department. That is sufficient for them.

More over I shouldn't ask you this question but sorry for asking. May I know is there any issues with the employer to get PF forms signed by them. More over U got relieving & other documents too. Then why don't they certify for PF forms. More over its their responsibility to certify the same even you can fight for the same.

If employment is running then only employer is eligible to sign the forms. If he refuses then you have to vist the pf commissioner and then he will forward your case to the concern Enforcement Officer. After this your pf process will be under the consideration of Enforcement officer.

Dear ACY,
All you need to do is to fill up Form No.19 and 10C and get is endorsed by your current employer and submit the same with the concerned PF Office and obtain a receipt for the same. The receipt is very important since you mahe have to follow up with the Pf authorities for your settlement. This will come is very handy at that time.
Of course, you will be entitled to submit your application for withdrawl only after 60 days of leaving your present employment.
