Hi All, I am working in XXX co. since 20 Months. Now i got a very good oppurtunity in some other company and i have resigned from my post few days back and i am serving a notice period of 4 weeks but as per my offer letter my official notice period is 8 weeks. Now i am ready to pay the compensation for not completing my full notice period and this is what i have mentioned in my resignation mail also. But now the problem is i am not having good terms with my manager so hes not accepting my resignation neither he is not replying on resignation mail and my company is very strict when somebody is not completing full notice period. Then i had a word with my HR director and even hes not co-operating with me instead hes trying to harass me. Now this is finalized that I'll definatley join the new co and they are ready to accept me without relieving letter and experience letter. now i am worried as it was my first job so whether i'll get my relieving letter and experienced letter later or not ? as in my offer letter there's NO as such clause that says if employee wants to leave the co. and not completing the full notice period so he has to compensate. hi sunny In your case you have submitted your resignation by giving 4 weeks notice, where as you got to give 8 weeks notice period. Is employer also to give you 8 weeks notice if he like to relive you for your services as per your appointment letter if not you are safe, as the law of justice must be equal on the side of employee and employer in any agreement made between. More over you are ready to pay the notice period wages then why you worry, you pay the wages for 8 weeks and take a receipt of payment and get away from the present job. The employer can not do any thing there after legally. At the most he will not give you the experience certificate. The new employer is ready to take you with out any revealing letter so you can join the new organization happily. Mohan Rao
