in general, the following leave is in practices in every organisation. you can make ur Leave rule based on as organisation and staff requirements

1. Earned Leave

Entitlement - 30 days in a calendar year.

Advance credit made in two instalments of 15 days each, on the first day of January and July of every calendar year.

Intervening holidays are counted as Earned Leave.

Can be combined with other leave except CL.

2 Casual Leave

Each staff member shall be issued a Casual Leave card at the beginning of a calendar year/at the time of joining, as the case may be.

All requests for availing Casual Leave should be made in the card only.

Casual Leave cannot be clubbed/combined with any other type of leave.

Intervening holidays shall not be treated as Casual Leave. However, total period of absence including such intervening holidays prefixed or suffixed should not exceed 8 days on any one occasion.

Entitlement - 8 days in a calendar year.

3 Sick Leave

Entitlement of 20 days in a year without any limit for accumulation.

sick Leave to be supported by fitness certificate on resuming duty.

Sick Leave cannot be encashed.

4 Maternity Leave

Granted to female staff members for delivery, to a maximum of 135 days. Admissible only to employees with less than two surviving children.

For miscarriage/abortion (induced or otherwise), total of 45 days in the entire service.

Maternity Leave granted as full pay and counts as service for increments.

6 Paternity Leave

Granted to male staff member with less than two surviving children, during the period of confinement of his wife. ie. upto 15 days before or upto six months from the date of delivery of his child and if such leave is not availed of within this period, it shall be treated as lapsed.

Paternity leave is granted with full pay and can be combined with other type of leaves.

7 Extra-Ordinary Leave

Extra - ordinary leave (EOL) is leave without pay.

EOL could be granted to a staff member who does not have any leave to his credit.

Sanctioned on grounds of prolonged illness or any other exceptional circumstances.

EOL upto 45 days can be sanctioned by Director. If beyond 45 days then it is to be granted by CEO only.

During the period of EOL, the staff member is not entitled for any pay and allowance.

Extra ordinary leave will be granted to a staff member in special circumstances as given below.

when no other leave is admissible;

when other leave is admissible,

Extraordinary leave cannot be granted to run concurrently with the notice period, in the case of officials has resigned.

Hi Sonali,

Even I started to work on these issues from scratch of our company and we are also a subidiary of US company and now I got around 3 yrs exp in this.

We, after much labor and workouts comparing to other companies are following leave policy:

1. Casual Leave: Total 12 casual leaves per year will be given. Not more than 3 consequent days can be availed as casual leave.

2. Sick Leave: Total 6 sick leaves per year. All the employees who avail sick leave for more than 3 days consequently, need to submit a doctor certificate.

3. Paid Leave: Total 6 paid leaves per year are given. Only these paid leaves can be carried forward to the next year if unutilized. Maximum of 30 PL's can be accumulated and paid at the time of employee's departure from the company. Calculation for the paid leave: Basic / 26 X Basic at the time of departure.

On a total, 24 leaves per year will be sanctioned. And one more issue, the employees who are in the probation period are not entitled to take any leaves. If the management feels the leave taken by them is appropriate, it's under management's descretion to sanction the leave.

Maternity Leave

1. a female staff members for delivery, to a maximum of 135 days. Admissible only to employees with less than two surviving children.

2. For miscarriage/abortion (induced or otherwise), total of 45 days in the entire service.

3. Maternity Leave granted as full pay and counts as service for increments.

4. Maternity leave may be combined with any other leave.

5. Maternity leave shall not be debited against the leave account

6. on expiry of maternity leave, femal staff can take leave upto 1 year for taking care her baby.

6 Paternity Leave

1. a male staff member with less than two surviving children, during the period of confinement of his wife. ie. upto 15 days before or upto six months from the date of delivery of his child and if such leave is not availed of within this period, it shall be treated as lapsed.

2. Paternity leave is granted with full pay and can be combined with other type of leaves.

3. the paternity leave shall not be debited against the leave account.

4. if paternity leave is not availed of within the period specified, such leave shall be treated as lapsed.

dear all
as concern to leave rules are concerned,first of all i would like to tell you that whether it is software company or IT based or US subsidery ,if the business is carried out in india ,all have to follow indian rules.
for leave policy in india one has to follow factories act or shops and establisment act.
however besides this any company can extend facility by their certified standing orders or certified service rules.

Hi All,
There are some IT companies which give 1 yr unpaid maternity leave. My question is ....
1. Is unpaid maternity leave is counted in experience?
2. If some has completed 5yrs in the same organization but this includes 1 yrs unpaid maternity leave also, is she eligible for gratuity?

Beside the company policies,EL ( Paid leave ) and Casual leave are under the statutory regulations.Normally Software comapnies are covered under Shops and Establishment regulations.In India,every State have their won rules..In AP,you have to give 15 days EL per every completed year of service and CL should not cross 12.
