I am working in a organisation for 8 months. My notice period is 3months, I had applied for resignation by july 02.

I had been insisting about buying my notice period in 45days but the organisation did not take any action against it.Lots of mails conversation between hr and managers.

It is around 50days, still the company had not got a replacement for me.

The HR always redirect to the manager and manager keeps on saying unless he get a replacement he will not relieve me.

Still date I did not get a resume to interview anyone for the replacement.

Can i take any legal action against the company for not relieveing me while iam ready to buy the notice period.

I need to join an company by 18th august , Iam ready to buy out the notice period.

Most of the time I am sitting idle in the company with no work, i am just being as a buffer only.

There is nothing to do as knowledge transfer also.

Day by day iam grewing anger , as for holding me for just being as buffer and sitting idle for doing nothing.

In between i had idea of quiting the company just like that , but my recruiting company said it is not the right thing and wants to be relieved formally with all letters from previous organisation.

I want to know whether :

1).Can i take any legal action against the company for not relieveing me while iam ready to buy the notice period. How long is the process going to take.

2).ls the acceptance of the resignation [email confirmation from company] is enough or the formal resignation letter is required.

Acceptance of resignation is sufficient. Explain your new recruiter on the issue n assure them that u vl get the formal releaving letter with in 2 months...hope this vl be useful for u........keep rockin....

Is there any option like taking action against the company for not relieving early, it sort of like torturing the employees to work even when he does not wish to work.
Here iam not escaping to do work , i had given them certain amount of time to get ready for recruiting another one in place of me.Also buying out the notice period.
last week , they sent 140 employees home just like that by giving three months salary.
when we employees do the same in return they are not ready to accept, i understand the business value and everything.

Hi Carthy, Don’t waste ur time n money by taking legal action. Tell ur HR tat u cud wait only for a week n push off....

Patience is more important in dealing such cases. Anger solves nothing but makes things more complicate.
Inform the situation to the new recruiter and convince them to extend the date of joining. Do not give them any hint on your aggressive thinking in the present situation.
Stay calm till all the process completes smoothly.
Take the matter as a test for you and, if possible, think from the employer's point of view with peace of mind.

Very first thing u must have to know that your leave should be adjusted against your notice period.
No matter where replacement is availble or not. once you have served the notice period company has no right to retain you......
Just let me know how many leaves you have in your leave account?????

Yep. I had to covince the joining company for now, The recruiting company is soft enough to consider my words.The joining company manager was kind enough to listen me.
My Manager doesn't even respond me in the current company. :!::!::!:

If you have accepted copy of resignation then you dont have to woory, otherwise send it again by mail or registerAD.

Only 8 Months you have worked, No stability Factor from You. Wat is the Guarntee that U will not do the Same in the New Organisation.

why this much hurry to leave the Job in Hasty. Above all the company has paid you for 8 Months. the 3 months notice period can be served.

If you r realyy interested in taking the new job with no frills attached, y cant u get a person from your own circle as a repalcement. I am aure you will have friends who will be in need of the JOB. thereby you are doing 2 good things

1) Getting a Job for the needy
2) Finding a good replacement for Smooth Transitition.

Wat legal action u will take. How much u wil pay for the Same. the company can very clearly say that the individual should work for the complete notice period.

Wat benefit you are getting from the New company, which you are not getting from the current organisation. why u decided to take a shift. Have u ever dicsused the prospects u will get in the new company with ur current superior & did u try understand or make it a point that u would wish to continue in the current organisation if the same prospects can be matched.

Y u r sitting idle. as u need to shift u will have lots of assignments to be completed. y cant u take that & complete that in a fruitful way.

Wat sort of knowledge transfer do u expect. How much efforts u have put in to gain the knowledge & u have put in to share the knowledge u have.

this is the biggest blunder u have done. it is very ridiculous to say about wat is happening at current organisation to the New Organisation. By this time they would have understood ur nature as a Person. Wat is the Gaurantee that u will not DO the same thing after 8 months.

It will be very difficult to do the same. Only on Mutual Understanding u can do it or else it will be very difficult my Friend.

As they have already mentioned that they require complete documents, it will be very difficult to prove your point. U have already informed them regarding the issues also.

Be Cool & Do some Self Analysis on the Following & take Decisions

1) why i need this job

2) wat will i get from the Job

3) is that short term or long term

4) can i get the same here.

5) if yes how should i get it & wat should i do to get it.

6) If no, y i am unable to get it.

Please take Decisions Furitfully

The company is being sold to another company, they already sent off 140 employees to home. When i joined this company 8 months back the HR said the company is doing good no need to worry. I was not informed about the organisation being sold.
I understand we have lot of scope for improvements everywhere, but when the organisation is not doing well on the whole and going to be sold off i need to be alert and move fast save myself.
Is is pretty bad why these companies hire someone, when they are not in a a good position and selling to someone.
That was a pretty nice take on resigning from an organisation.
It is bad to see someone not doing anything and of the same ranking and getting double the salary in the same company. That really makes awkward.
Why dont they normalize the salary for all in IT industry, how long is this going to occur.
