Dear Senior,
Please inform me that I am working in a construction company. Here min. 5 employees join & left our Org monthly, I am talking about new joinee. We have to paid their salary, but I want to know that whether they are eligible for EPF or not. What is the min. days of working of a employee for EPF.

Dear Sanchita,
Applicability under EPF & M.P Act 1952 on statutory basis is 20 or more than 20 employees in any working day.
In case you have labour turnover in abundance then you just have to take care that if you reach 20 nos then your statutory bound for the Act.
In case you want it to opt voluntary there is a provision in the act
u/s 1(4) but has many paper work in it.

It is mandatory on the part of the employer even any employee has worked for 1 day to remit his PF to EPF. Earlier waiting period of 60 days was allowed but with amendment that waiting period has been withdrawn.

Mr. Ridham,
Can you help me that one employee may be will leave our org in this month, so my boss doesn't want to include him in EPF( he worked from Feb'09), though we got PF no. in this month only. Shall I hide his name & contribution from EPF?( i didn't deduct any amount from him) or may be if he will continue work then only I will submit all PF amount to EPFO, is it feasible or it is a illegal?
Please inform me.
