Hi,
An Employee resigned form the services in 4 days giving a reason of Personel issues and when asked to serve the Notice period,He is denying to give so and saying to teminate ASAP.
Can anyone guide me how do I tackel this situation.?

The reason for this sort of abnormal behaviour is he might have got a good offer else where. If the employee is not willing to serve the notice period then u dont have any options. Tell him ok we will terminate but the same will be mentioned in ur service and relieving letter too as well as same will be communicated when we recieve any reference check on behalf of you from any company. Can u plz specify whether the employee is fresher or experienced??????????????

The employee is a Experienced person and he is not asking for any Reliving letter or experience letter or salary for 4 days.do you suggest better to send hime the termination letter.
Can we do any legal action saying to pay the Notice period amount?

he has just served for 4 days and no body will write 4 days service in his resume so he donot need relieving letter.in my view you should forget him and search new employee.
there is no use to go for litigation and you will not get anything from litigation.

You said, he is not expecting any experince letter or four days salary from your firm, it shows that he might have got a better oppurtunity in some other company. If you think that he is really suitable for the assagined job talk with him once again regading continution in job or any salary issues, if failed, do the exit formalities legally.

Think from the time of recruitment, the interview process, the Salary negotiation process, the job description for him,,
How many people have left from your organisation like this,,, (in Short Span)

I would suggest give him termaination specifying that he has submitted within 4 days and is not willing to serve the notice period so you are terminating him with immediate effect, even if its for 4 days and keep it for your records.

Something wrong with him or your organisation. What made him to exit within 4 days? There may be some good reasons and try to find out those reasons for analysis. No one can stop him from relieving on his own. If he has taken salary or joining expenses reimbursement, there is a point to pursue. Better let him go.

same thing happened in our organisation. The employee simply left with out notice period. When we asked him to serve notice period, he simply say " i no need any F & F settlement and also experience certificate/ relieving letter".

There is definately something more than meets the eye .. you need to look inwords to see how this person was treated on joining ... and surely he has a better offer undoubtedly . .. Dont waste your time go ahead and look for a replacement - you can change a persons destination NOT his destiny
