Dear All,
Iam working in a company, in which the company does not pay Esic & Pf to the employees. My company is registered in pondy, and in chennai we did not registered our company, that to we are selling the product in three different company names. Other than salary there is no benefit for us. not even a cup of coffee or tea to the staff. Please guide me how to take up this issue. Any thing we have to consult with our MD. Without MD sign not even a single pin can go out. Please its very urgent.
where i have to log a complaint about this. Please guide me

hi,

In your case, your company is functioning in three differenct names to save the tax, if the employees are also divided in these three companies then you have to check the headcount. If the headcount in each company is more than 20 then PF and ESIC is mandetory. You have to check out wheather your company is registered with PF or not. IF you have PF no. of your com. then approch to your MD and tell him that if we did not apply rules then punishment can be upto impresunment.

first check out that you have headcount of more than 20 (onroll).

Try to convience MD as showing the benifit of PF and ESIC. As they are running the company in three different names, it shows that they are cost sonsiious, tell them that the amt contributed to thses schems are having Tax benfits. this will help you.

Prepare a letter for applying for the PF (opeing the PF a/c) of all employees and with the signature of all the employees submit it to MD. Make sure u have the acknowledgement copy of it.

For other matters like facilities, you have to do the same thing. Once u gegistered with ESIC then you can give a written complaint about this. mentioning poor employee welfare.

Hi,
Even our company also donot pay ESIC and PF to our employees and we are more than 60 employees.
From here we can conclude that it is MY DEAR COUNTRY INDIA.
Eveything is possible, nothing is impossible in this country.
So dono worry untill unless u r being paid atleast the full salary and on time.

Hi friends,
Many companies are there in India, they are not giving any facilities to their employees.
In these comapnies MD is all in all. So, if u fight against them u have to lose your job. My company is a Ltd., company + family business. We are getting PF etc., but still management means MD. If he say something that's all that's the rule. Even we are paying for our tea/ coffees, company is not giving anything. Many people fought for that and lost their jobs.
Please if you would like to do something, let it be a teamwork.

What is the solution for pf & Esi. Where we can file and log the complain. Please guide me whether it is possible to log a complaint on employer.

Dear Kumaran, First check ur appointment letter and CTC letter. and then check is ur company is registered with ESI and PF deptt or not. then only v can gv u perfect advise. rgds

i dnt agree to you...see in dis world u got to fight for ur rights...dnt expect people to come up to u n giv ur rights....y wud a company like to increase their cost on u...but den u got to claim wat u guys actually deserve...as per law....if u let go everythg n be satisfied and dese laws hold no meaning den...its for ur good......do i need to explain u d benefits of ESI and PF...

Certain factors are to be taken into consideration. Check you company's incorporation. Whether it is new or old. Check PF & ESI Registration with ESIC or RPFC. Check how the salary are disbursed. Whether or not proper documentation of salary details are recorded. Statutory compliance is must. Check how well you are unionized.
Raise the issue with the govt authorities confidentially. Ask the inspector to inspect & visit your company. Precautions and Tact is utmost in these cases. If you get an opportunity to explain the benefits of these compliance explain and convince in a positive manner.
Talk in the interest of the company. Your presentation matters a lot.
Before initiation go through the Acts sincerely if possibler consult a labour advocate for tips as well.
How you represent this issue with your MD matters a lot. Better develop first a good interpersonal relation with your MD.

I think Pondy is an exempted place where PF & ESIC are not applicable. You can have your own NPS account even invest in PPF account. Your can have accident insurance, mediclaim insurance at corporate level which will save you by getting group discounts. In addition you can have Superannuation whereby you contribute some amount and the employer equal amount.
