Can we employees of transport claim benefits which are given to factory workers like bonus, esi, pf, etc?
Boss has 2 different companies one is a factory and the other is a transport service provider with less than 10 employees from the beginning. the transport business does 80 work for providing transport facilities to her own factory and 20 work for other clients. after lockdown to reduce her rent burden she shifted all her transport staff to her factory. they solely do work of transport and are in no way related to the factory work. can we employees of transport claim benefits which are given to factory workers like a bonus esi pf etc? if she is making us do work of the factory how can we prove that we are working for the factory since we were never appointed for the factory? we are doing very small works though but are scared if in future she makes us do a lot of work of both factory and transport and makes this shift to the factory a permanent shift.
Who is a motor transport worker by the mtw act?
Dear all i would like to know who is a motor transport worker and what is a motor transport undertaking as per the motor transport workers act 1961 with clear examples please. what i am looking for is not reproduction of the definitions available in the bare act but some live examples. for example if a bpo company has its own fleet of buses and transport staff like drivers will the company then be called as motor transport undertaking? the driver as motor transport worker? in another case if a company uses its own fleet of trucks for transportation of scraps from one of its godowns to a dumping site will then the company attract the provisions of the mtw act? the cleaner boy attached to the truck will be a motor transport worker? if someone can elucidate upon the overlapping areas between mtw act factories act and shops & establishments act and the problems faced by the organisation due to such overlappings and ambiguity it would be very interesting for enhancing our knowledge on what is happening in the country on these legislations when they compete with each other for covering the same organization. in anticipation of your valuable responses govardhan
