Hai Friends, I would like to know the concept of "compensatory working day".We are clear about the Compensatory Holidays as per the Factories Act, 1948.I would like to receive clarification on what would be the case if a normal working day is declared as holiday due to business requirements and within how many days this can be compensated as compensatory working day as per Act. Hi Joseph, Compensatory working day is basically due to exegencies or on request of the staff / union, a particular working day need to be declared as a holiday and to be compensated by working on a weekly off day or on a holiday. This is mutually agreed hence at the time of declaring holiday itself both the parties will agree and document. The timelines like when and where will be discussed agreed, when it is mutually discussed and agreed then there won't be any issue but better to work with in a maximum of 3 months.The document or the agreement should also specify that on that particular day if any body is absent or any body is leaving the organization then the same will be adjusted to the leave balance or one day salary is deducted.
