As per labour law for shops & establishment total working hrs for the day are 9 hrs and 48 hrs per week. Does it inclusive of lunch break (1hr)?

dear sir if it is general shift,shift hr-8.00+lunch hr-1.00=totaly=9.00hr /day but one week=6*8=48hr. so your time include lunch break also. perumal.

Sorry we did not get the clarification about 48 hrs. is daily lunch break is included in 48 hrs ? if 9 hrs per day then it should be = 9*6 = 54 hrs. (it includes lunch break)

Shops Act is a State subject. Most of the states have enacted this Act. This Act provides proviso for working hours, rest interval & spread over for employees employed in the Establishments. In general actual working hours are eight hours but this may be up to 9 hours per day but at the same time we are not allowed to take duty from an employee for than 48 hours in a week. In this way we are to adjust the working hours keeping in view both the points while deciding the working hours. Plz go through your State Shops act for this matter.

Yes,it is same for IT companies too,however keeping in view the deadlines and the pay package of IT professionals nothing really stands as protection for them. Their work schedules are project driven and if any one refers to any act in this regard he / she will be shown the exit route.
However the project managers are authorised to give compensatory off to their teams which can be purely to take rest or to attend exigencies etc. Also look at any senior positions in the companies for that matter. Who can claim a 48hours work schedule in India ?
That is the reason we have concepts like flexi hours and work life balance - much hyped and practiced in IT industry.

Yes, it is inclusive of lunch break. As per the law total working hour inclusive of lunch break can not be more than 09 hours a day and 48 hours in a week.

Yes, Total working hours is 8hrs and 1hr for lunch break but most of the companies will allow only 1/2 hr break but that's not the correct one.We should allow 1hr break for our employees.

As per reply posted to this querry, if it is 9 hours per day and max. 48 per week then an employee working for 9 hours per day 9*6=54 hours per week then he should get an overtime payment for 6 hours per week. If you will calculate this overtime of 6 hours per week means 24 hours per month and 72 hours per quater then it violation of labour law.
Generally in any organization employees are working for 9 hours per day. It means lunch of one hour is not included in the calculation of working hours.
Please draw further light on this matter.

There is no question of overtime. The Act speaks about working hours only and there is no need to include lunch hours in the working hours. We have to provide rest after continuous working of 5 hours. Hence 8 hours working and one hour lunch will not be counted as 9 hour working.
