Please Help me for some legal labour laws.
I would like to know how to calculate salary for employee as per HR rule I explain u following example:
Suppose minimum monthly wages fixed Rs. 3692 for a unskilled worker
for month of Jan his attendance 7 days + one weekly off = 8 days
should i calculate salary as :
3692 / 31 = 119 * 8 = 952
3692 / 26 = 142 * 7 = 994

Dear Rajesh Rai
The salary has to calculated by dividing the numer of days in a calendar month and multiply the result with (No. of working days + Leave days {if with pay} + National Holidays + Festival Holidays + Rest days).
In the present case the calaculation for month of Jan where you have stated that his attendance is for 7 days + one weekly off. The caluculations has to be like this:-
In month of Jan. one National Holiday falls i.e. 26th January. Thus you have to pay him for 7(Working Days)+1(National Holiday)+1(Rest Day)=9
3692 / 31 = 119 * 9 = 1072/-

thank you for sharing these links. Do you have the white paper which has been issued recently on Employee Pension Scheme where in they have given the process of calculation of pension amount of the employee, or, any process of calculation which you have.

HI Deepak, i have a query in MINIMUM WAGES, THE MIN WAGE MUST BE BASIC OR GROSS??? Say if for one category min wage is RS.4577, how we shoULd take this gross or PF? THANKS IN ADVANCE jai

I was looking in the payment of gratuity act document the amendment which was recently given by the govt in March 29 th the GSR 194299 and GSR 194298 mentioning that 10 lakhs has been changed to 20 lakhs and also as amended from time to time which was not there in section 4 subsection 3.
If you have the latest document on that can you upload it.
