Hello we had asked an employee to resign because some qualifications were misrepresented. now should we tell the background verifiers the reason why he was terminated or should we provide the same information as we do for regular employees that leave on their own. alka

Dear all there are situationswhen certain employees are asked to leave and threatened that if they do not resignthen they will be terminated.i would love to get your suggestions as to what the employee can do to defend.
Is notice period deduction is appropriate even if company is asking for resignation
Dear seniors there is case: an employee who has worked for an organization for more than 5 yrs has been asked to resign due to his poor performance of last 9 months. organization has accepted the resignation and relieved him instantly. they subtracted one month notice period from his full & final as per contract of employment. now the question is: if the company asked the resignation for poor performance then why notice period is deducted as per my understanding employee should get the salary in lieu of immediate relieving although he has not been terminated. looking forward for your precious suggestions. regards mn khan

Dear peers i have a question. please reply. one of my colleagues was asked to leave the organization just because additional head count was not approved for the department. she served the company for two years. new employees were brought in the same department and this employee had to sacrifice her job. there was no issue with her performance. was this the right decission the management has taken in regards to her termination. what can you suggest for the employee who is asked to leave. please evaluate and respond.
Legal guidance on being terminated for being paid higher salary
Hello friends . i have been working for a jv pvt ltd co for the past 5 1/2 years & am responsible for the entire operations of the organizationi was responsible for setting up the organization recruitment implementing sop s systems etc & have been managing it quite successfully since inception.i have been rewarded well by the management for my exceptional performance . however off late some of the board members feel that i am paid more & are looking for a replacement at a salary lesser than me .the organization is doing very well & making handsome profits year on year basis. what is the legal recourse for me if i am asked to leave.thanks
Termination due to an incorrect feedback
Hi seniors i have joined one organization and after 15 days the hr called and said that in my background verification they have found something which is red and so they again asked me to submit few other document which i have already submitted.i was not having good relation with my last to last organization manager and he told my new company that i was forcefully asked to resign which is completely incorrect and i resign myself and i having all my relieving letters as well as f & f statement.moreover i report to there manager s but my new company asked information from only one.further to that i worked for 4 companies and there my record is always good. now i being terminated without given fair chance to even prove my honesty. now i am jobless and i really dont know what to do.would request if anyone can help me out so that i can stand myself infront of the company.
