Dear All,
I would like to know that whether there is any importance of having legal knowledge while doing performance / yearly appraisal (increment) of employees?? is there any law in india also like other countries that if PMS is not done or hold or some negative comments are written then they can sue the employer on basis of that?
What if company holds the yearly appraisal and not giving any satisfactorily answers for that, what should a hr manager can do if employees are asking for the answer and management not giving any to the hr manager? Also if there is no appraisal policy in the organisation as it totally depend on managements wish how much to increase not in terms % age?
Hope to recieve valuable suggestions on this topic, as presently i am working on it.

basically peformance apprasial and increment both are different.performance appraisal is one of the tool for increment.
there is no law for increment in pvt sector.it is the choice of management to do it once,twice or any number of times in a year.
as a manager HR you can say to employees that managment has not yet decided on this point.

Thank you Mr. Malik,
I know performance is different from increment appraisal, but in case of managemenet not doing increment is something different as it is done for some employees without any consultation or information of HR, but on discussing the yearly salary appraisal of other employees bosses change the topic. From last 3 months i am convincing them the same thing you told me but now as they do not say anything to management they all are looking for new opportunity and what my concern is not to loose such good team in any department.

yeah a good question.. even I am suffering a lot with employee. first of all employees doesn't perfrom well n ask for appraisal or increment..
Increment should be given based on the % decided by the company but how abt the appraisal.

Even we are also facing the same problem. We are done with performance appraisal. Only commercials need to be announced. I am also replying the same answer that we are waiting on Management's decision.
