In the offer e-mail my employer had mentioned that the they were ready to buy back my notice period salary but would recover the same if I resigned woiyhin one year. However there has been no mention in my appointment letter (hard copy receipt of which has been acknowledged by me). Now since I have resigned from the company, does the company have the right to recover the amount. In my opinion they cannot as offer letter does not have a legal binding on both parties. please let me know the correct stand. Also if need to take up the matter legally please let me know whom to approach.

If notice period clause is not mentioned in you offer letter or appointment letter. Then according to me they can not ask for notice recovery. Kapil Kotwal

first let me tell you that you are not the person of words.once it was decided that
company will buy back your notice pay if you serve for one year.
on what basis we work with company ? that is contract basis we work with company
and company has mentioned this clause in offer letter which you have accepted.
dear ,what else you want you have accepted the offer why it will not become a legal
document.

Firstly i would like to thank sir for such a good guidance.. My inputs on this are.. firstly we need to become good Human beings before being employed any where, because principles and ethics only can have you maintain good and bright career.
Before even facing such situations always please have empathy towards the present employer, dont forget the present employer has accepted you even before any body has accepted you and given you an opportunity to work, without which you could not have been what you are today,
