if someone has worked for 80 days than she is entitle for 12 weeks maternity leave with full salary.if you have not given any prenantal check up help than she is entitle for 1000
rupees as medical bonus.

Hi Dear,
If she is including in ESIC Act, then company don't have to pay maternity claim she can claim from ESIC.
But if she is not including in ESIC Act then company have to pay 12 weeks salary. 6 weeks before due date & 6 weeks after due date of maternity.

Every women is entitled to get 45 days before the due date and 45 days after the delivery of her child.If covered under the ESI act then she can claim the benefit from there other wise during this period a company will have to pay her full salary.
It applies whether the child born is alive or dead or she had any mis carriage.

dear anamika it is not 45 days ,it is not more than 6 weeks ie 42 days before and 6 weeksafter date of delivery.in case of miscarriage it is only 6 weeks. tks js malik

mr chetan,
mr. malik ji is absolutely right, in case on miscarriage only 6 week only. and for delivery case 6 week befor the delivery and 6 week after the delivery i.e. total 12 week maternity leave is applicable.

if miscarrage, then only 6 weeks. if delivery, then 6 weeks before delivery and 6 weeks after delivery total 12 weeks leave, full salary for the entire 12 weeks period .
