sir pls help me i am working with a company where is 15 person are employed we use power, but the electric meter is landlord name we pay only building rent,in the same permises other shed different name factory working which is covered under the factory act,sir pls tell me we are covered under the factory act if we are covered we need a seperate factory licence or not,

you should be covered under factories act and you should obtain seprate licence.power does not only mean electric power,if you are having any other source of power like generator ,that is also power.so it isa immateril whose name power connection is there.

Dear Hitesh,
The first and foremost criteria for applicability of Factories Act, is if the establishment carries out any operation which falls under "manufacturing process" as defined under Factories Act.
If it falls under manufacturing process and it is carried out by 10 or more workers with power OR 20 or more workers without power, then it is defined as a factory provided it does not fall within the establishments which has been excluded in it's proviso.
The source of power is not a defining criteria so it is immaterial under whose name the Electric Meter is present.

It seems that you are in some manufacturing process and using machines for manufacturing by electric power. so, automatically you are coming under factories with that 15 employees. As per the act, if you are in the process of manufacturing with power 1/4 hp with 10 employees you are coming under the purview of factories. And more over, it is your own meter or bowrroing power from some where, you need to get a seperat license of your own.
