We are having a Liaison office in Gurgaon (since 2005) for company based in US. Presently we have 11 employees working here in India office and we dont have any worker i.e labour class. Can some one suggest me that do I have to still deposit in Welfare fund i.e employee share Rs.5/- and employer Rs.10/- for employer. If yes why ?
This is to inform you that your office is covered under Shop Act,1958 & Punjab Labour Welfare Fund Act,1965. After the latest amendment dated 04.04.2007 every employee is covered above the level of supervisor also. Thus you are to send this contribution from this date onward. Before this the worker category & clerical staff was covered under the definition of employee.
