Our company have sub copntracted company B to supply with labour to work in the warehouse,however during the course of working one of their employees is ran over by our staff bus,we sent him to the hospital and kept paying him his salary for a year.Are we oblidged as a company to re employ him,bearing in mind that he was a contract worker,and also he was given all his national benefits by National Social Security Authority (ZIMBABWE).

No ....your company is no way responsible for re-employing the contract employee. Hope your company has executed a contract agreement with the sub-contractor, entailing job responsibilities.

Hi,
There is a supreme court ruling which clearly says that Principal employer is not obliged to provide employment to any employee/labour working with the organization through contractor.
However, as a principal employer you need to see that all statutory dues are paid to him as long as he is working with your organization as a contract employee through contract.
