Hi Friends,
There is an interesting case, I want to put forth you.
If an employee resigns and comes after 2 yrs to collect his dues would it be the laibility of employer to pay him.
Here, my question is that till how much time period we can hold the final salary.
Secondly, where this amount of final salary will go. Will it be deposited back in to company's account or some where else.
I tried to serach it online and some bare act but it was in vain. Please also give me some reference for it, some judgement/Order or abstract from any act because I have to dicuss this with finance people:mad:

Dear Sandeep,
According to law, we have to wait till three years for employee to come.If he does not turns up to collect his dues, we will intimate him through post to collect his dues and even if he does not come, we will have to deposit the amount in Government's Labour Welfare Fund.

dear unpaid wages to deposited in labour welfare fund as sangeeta said but i think now period is changed and it should be deposited after two years. tks j s malik

Dear Sandeep Kulkarni.,
If you have not deposited this amount with the Welfare Commissioner then pay him his legal dues. State Labour Welfare Fund Act shows the period of witholding of the unpaid accumulation by the employer. Plz go through this Act & take action accordingly.
