Gratuity incase of retrenchment
I have been working for a private company for the past two years. at the time of joining they gave me a ctc calculation where gratuity is shown as part of ctc. now that the management wants to retrench some employees stating that they do not have any projects. can the retrenched employees claim the gratuity because it is the act of the management to retrench employees and the employees were willing to work for more than 5 years. can someone explain how the retrenched employees can claim their gratuity since it has been shown as part of their salary.

I am working in telecom field and my company has assigned me a new task that is to check and confirm how many employees are not going to the field and just sittind idle in homes or doing some other jobs. my problem is if i confirm with them then they have a valid answer for me and if i confirm with field supervisors or field manager then they might also involve in that fraud and give me fake information. so please suggest me that how can i track those employees and what is the best way to improve the system to get maximum productivity. your help will be highly appreciated

Dear seniors my company management is supposed to retrenched the some workers however our company is registered in up shop & commercial establishment act. 1952. also our company employees strength is 96 inclusive workman and non workman... however the reason for retrenchment is financial crises. pls clarify... my following doubt... 1 do we need to take prior approval from state govt in order to retrenched the workers 2 how many month notice shall be served to the workers whover is in continously service of more then 1 year weather 1 month or 3 month 3 the workers whoever has not completed 1 year service in our company weather these workers may be retrenched or not if yes how many month notice will be serve to these workers 4 for calculating retrenchment compensation weather basic plus da or gross salary will be taken thanks in advance.... rachna
