Hi,
I am new to this site. This is Jisha here. I am working in a PET Packaging industry. I have posted a question earlier also but there was no response. I need your reply on this matter at the earliest. I wanted to know about the PF & ESIC for contract labours. Who has to take the liability ? Is it the Contractor or the Prinicipal employer. Please also suggest some readings for the same. Any law book or anything on the internet ?? Please also send me a format of Contractor's Contract / Agreement.

Dear Jisha Prashant,
If your unit is covered under the ESI & PF Acts then the contract workers will also be covered under these Acts. If the contractors fails to deposit the contribution of their workers then Principal Employer will also be held responsible for non compliance. Thus ultimate responsibility lies with the P. E. For more details you can aslo open the site of esic.nic.in & epfoindia for these two Acts in question. Bare Acts are also available in market.
