Hi All
We have practice in our company providing 7 SL to all.My querry is
1. Who are eligible to get SL.(means only those who are exempted under ESI Act or all employees)
2. How much SL leave can be carried forwarded at the max.
3. What is the procedure of SL encashment.
Kindly refer me under which section or clause where it has mentioned.

Hi,
As per S & E act the sick should be 10 days and which can be extended up to 12 days and this two days will depend upon the companies discresion.
And the same has mentioned in the clause (F) of S & E acts, if iam not wrong..kindly check with the baracts for more details i.e. particular state coz it will get very from state to state.

factories act and shop & establishment act of different states have different provision regarding leaves.

Sir, Our establishment registered under Factory Act 1948 & Punjab Factory Rules will be applicable.I m working in Ludhiana. regds

Thanks Charan But our company is covered under FActory Act1948 not under shop & establishment act. Punjab Factory Rules shall be applicable.Please reply accordingly.

sick leave in factories are given as per certified standing orders to those personnel who are not covered under ESI.these leave are not carried forward or encashed as asked by you.
if any thing special written in punjab factory rules than you can refer the same.
it is general tred in companies covered under factories act.

Dear Khantri,
It was an interesting question, My observations are:
ESI and S&E acts are applicable based on the business, work and environment of the company. Which you need to describe about. As ESI is applicable when the employee working with the external power and so on......
ESI act discusses the benefits that employee gains from company and govt on illness not on the leave (I guess)
Usually every establishment allows 12 days of SL as minimum and can be extended on management decision.
No Sick/Casual leave can be encashed or accumulated.

as you are in mumbai and if you are covered under shop and establishment act than there is no provision of sick leave in bombay shop and establisment leave so you can make your policy as per your own choice if u want to give sick leave.
if you are covered under factories act than sick leave is given as per standing orders of the company which is generally given to those employee who are not covered under ESI and no provision for encashment and carry forward.

Sir,
Iam working in U.Pand our factory is covered under factory act,I have a small query
1. whether holiday,weekly off & national holiday comes in between Earned leave in that case whether these holidays are part of leave or treated as holiday not inculded in earned leave.
