Dear All, I am working in Milk industry which works 365 days. I need your help on leave policy. As per our policy, festivals holidays are included in this leave policy. So if a person is taking a leave on diwali it will be deducted from his leaves. Following is the leave structure: 4 National Holidays. 3 Sick Leaves. 18 PL. No festivals leaves except it. This policy is for all employees and workers. Kindly suggest me the best structure as per the industry nature as milk factory works 365 days. Also suggest the way to present the leave policy to management. With Regards Jigar Gangar

dear jigar it is not like that and you are required to atleast follow the factories act provisions.see ,you can give more leave than the provisions given in act. 1.national and festival holidays does not have any concern with leave.you are working 365 days but inbetween you are giving national holiday also.you are reqd to follow your certified standing orders.if you donot have than follow model standing orders and atleast pay 7 days holidays including 4 national rest festival holiday. 7 casual leave, paid leave/earn leave 1 day for every 20 days working sick leave 10 days for those who are not covered under ESI . dear this is bare minimum which you should give . tks j s malik

Dear Jigar Gangar, You are advised to go trough your State National & Festival & Casual & Sick Leaves Act, if applicable, for the grant of these National & festival holidays & Casual & Sick leaves & for earned leave examine the leave with wages chapter of Factories Act,1948. Present these statutory leaves before your seniors for decision. Regards, R.N.Khola (Labour Law & Legal Consultants)
