We all know that it is mandatory to close offices on the day of voting, and there is a legal penalty for opening the office that day.

If we give employees the day off on the voting day, can we compensate by having them work on another day?

Yes, you can give the compensation by working on any other day before giving the day off on Election Day and ensure that the gap is not more than 3 days. Maybe you can work on any Sunday and give the day off on Election Day. It should be brought to the notice of the Inspector of Factories if applicable.

The holiday for casting votes by employees is expected to be a paid holiday. If you direct employees to work on a Sunday or any other off day, it will again be a paid day though not necessarily be at double the rate of pay by interpreting it as overtime day. Therefore, there is no meaning in calling employees to compensate the day lost.
