Dear All
I would like to introduce my self.
Iam Praveen Vahinipati working as HR Officer in Transport corporation of india ltd.
Iam having one critical problem can any body plz help me. its very urgent.
We are haveing Transportation contract with GAIL(gas athourity of India ltd)
for that we engage some labors for loading & unloading of materials.
Now the problem is that GAIL wants that those labors should be our (TCI) employee.
There all statutory requirements should be fullfill by us.
My question is that can engage those labors on contractual basis?
Is there any problem arises on their termination ?
what are the different conditions when labor can ask us to make him permanent employee of TCI ?
How can we defence ourself from all those problems ?
plz help me as early as possible. its very very urgent ?

dear praveen
you can engage labour on contract basis .bascically ,it will be a sub contract.in this case you have to be a principle employer.you have to register yourself with labour authorities to hire contract labour asnd contractor will take licence to do so .they will be employee of contractor and they donot have any relation with TCI.

in that case u keep them on your roll and to avoid all these problems u issue them fixed term appointment for 6 moths and make a rotation and carry on changing after every 6 months,
