Hello All,
I have one query regarding Maternity Benifit...
One employee who is working in our organisation since last 1 and half year, he is covered under the ESIC Scheme...
Now the issue is that his wife is pregnant so i would like to know that whether her wife is eligible for the Maternity Benifit or not if yes than what are the benifits should be provided to her...
If her husband does not want to avail the maternity benifit from ESIC than what are other option? can the employee ask for the madical rembursment if the dilivery is done in the private hospital...
Please guide me...

Dear Friend,
Request you to note that the Matenity act is applicable for the working women ( employee ) only whose salary is over and above Rs.10000/- pm other wise the ESIC will take care of their maternity benefits if they are covered under ESI act. If the employee is not covered under ESI act then the Maternity benefit act is applicable for the employee only. No where the spouse of an employee is eligible for Maternity benefit under maternity benefit act or ESI act but if the employee is covered under ESI act then all types of treatment wrt maternity will be extended by the ESI. No responsibility lies with the employer in reimbursing the expenses wrt spouse of the employee even he wants or don't wants to avail the benefits under ESI schem.

Dear,

In order to be eligible for maternity benefit under ESI, a woman employee should have contributed for 70 days in the preceding two consecutive contribution periods. Therefore, the actual or expected date of confinement should fall within the first benefit period. Even a woman employee who had contributed for more than 70 days in the contribution period will not be eligible for benefits if her date of delivery takes place before her first benefit period.
In the absence of information about the contribution for the preceding two contribution periods (the post only gives that there were 30 days contribution in the contribution period just preceding the date of delivery) and the actual or expected date of delivery to see whether it falls within her first benefit period it is not posible to give a proper reply.

Hi,
The Maternity Benefit is applicable for only those who are working women in the organization and that to they have to be covered under the ESIC Scheme then only the benefit will applicable if the working women is not covered under ESIC then the company will provide the Maternity leave to her

Employees wife can have treatment through ESI and avail all medical benefits. Employee is not beefitted with any leave through ESI.
He is not eligible for any re-imbursement if the treatment is taken in a Pvt. Hospital.
How ever, if the company has got some Group Mediclaim Policy for their employees and their dependents which covers maternity benefit. He shall get the reimbursement.

if a person,s salary is more than 10,000 and he is nit availing ESIC benefit.then what is the procedure to claim maternity reumbersment for his spouse.
