Dear all,

Greetings to all of you. I need guidance from you all regarding my issue.

I had joined a manufacturing company few months back. During interview or at the time of issuing appointment letter i was not told that I have to sign any service bond in future. After few months of joining company, my employer asked me to sign a service bond for heavy amount (approx. indian rs. 14 lakhs) which is much more than my annual CTC. When I refused to sign, they asked me to leave job and hence unwillingly and forcefully I had to sign a bond. But it was not signed in front of notary or in court. All these things happened within my probation period.

Now because of some personal reason, I had to break it and come to my native place. I have just completed my probation period at the time of leaving job but not yet issued confirmation. My employer is asking me to pay their expenses or they will approach court for legal actions.

I would like to know if it is legally right? If my emploer can really take any legal action on it? What should be my responce on it? Please guide.

Thanks in advane,

Nishant

dear nishant
i have written earlier also regarding this query raised by someone and all our friends from cite HR agreed for the same.this type of bond does not have any legal authenticity.you have to follow the terms of appointment letter for one month or three month notice ,if it is given in appointment letter it should be followed.
donot worry ,chill out, legally they can not take anything from you.
tks

Dear sir,
Many thanks for your prompt advice.
I had referred few cases before I post my query. Please check below mentioned query of user "money 24" and answer given by Mr. Madhu T. K. (board Moderator).
My case is somewhat similar, I had attended abroad training ( which was totally useless and arranged for making training bond only) and company is asking for training expenses, which are very high and as per their standard in Europe copuntry.
You are requested to refer below mentioned comments and please do let me know your opinion again.
Many thanks,
Nishant

Employment Bond is illegal. But this does not mean that an employee who had undergone a training at the cost of employer and gained knowledge out of such training shall just leave the company before a reasonable time and without paying it back in the form of resourceful service. If an employee do so, the employer's interest to get back the amount spent by way of training will be protected.

Dear Sir,
I have the same problem. I have got a good offer just after completing the training overseas. Company got signature on 2 yr bond with amount 3.5 lac.
Although I did not sign on stamp paper. My colleague did it for me. He write everything for me and also made my fake signature.
The front page was the only stamp paper. On that paper no conditions were mentioned. Only "Tripartite agreement" mentioned b/w me, my surety and my company.
My colleague also wrote his name and address in surety.
I dont want to miss this job opportunity. Please help me.
