Dear all,
I m working in ophthalmic lens company ( the join venture partner(50%) with world best lens company ) as Asst manager –HR
From august 2007 but now management gave me 2 option ether I have to change my dept or give resignation or they will give me termination letter than I refuse to change my dept now they want my resignation without any specify reason . and my aerials and medical & LT still pending with company but I don’t think now they will ready to give me and still I dint get my confirmation letter and one more thing I sign one agreement for 4 yrs.
Kindly guide me for the above .

Dear Rekha,

You are not a single with this situation.

Please go through the agreement that weather it is a sole discretion of the management to terminate the job before completion the period and without giving the prior intimation / notice to terminate the job ? if it is so, than you can not do any thing except putting up regination.

If you are deligent towards your work than there is no right of the management to terminate the job without giving prior notice. please quote to the management in writing in a soft language regarding the clause of agreement and ask for your all pending dues if required.

But please think 100 times before leaving the job because if in case you change the department, than there is a possibility that you mab relocate to your previous position in near future.

And be sure that you should have your confirmation letter once you join any organisation in future otherwise you will not have any tool left for you for future safety.

Please refer to the agreement you signed i.e, exit class in the agreement. Is your employer is complying the requirements as per the agreement.
One thing I am not clear is you are working as Asst. Manager HR for almost 2 years. Your superiors / Management should have trust in you to the extend of giving the reason for transferring you to other department or asking you to leave. You might have also seen what is going on in the organisation.
Study the reason behind their move. Analyse and act.

Hi Rekha,
When you management says, change in Dept so which dept they want you to transfer. I suggest take a change in dept and then start looking for a good job in HR. You may find it difficult to get a job if you are unemployed. Also you never know you may even enjoy the new dept or new job role.
Also why did you sign a 4 Year Contract. It is the most stupid thing I have ever heard of. Anyways never repeat this mistake in future.
Also you can send me accross your resume to and will try and help you with a job in my company.

I would suggest you to change the department for now to save your job & to get the pending payments. Being an Hr professional you should be through with the exit formalities. Next look for a better opportunity and next time its better to avoid contractual assignments.

Hi Ms. Rekha,
changing dept is not the solution bcoz ur working as a Asst manager since 2 years n suddenly if u chnge ur profile it wil be difficult to u in future. so plz understand the present situation and negotaite with the mangnt till u get the other job. and u even find the reason for this move and update urself.
