The Standing Orders will have to be approved by the Labour Authorities of the respective State Governments. This means that there cannot be any common standing orders for a company. S. Krishnamoorthy

Hello,

Industrial Employment (Standing Orders) Act 1946 is a central legislation and is applicable to any industrial establishment employing more than 50 workmen.

However, in Maharashtra, the Bombay Shops & Commercial Establishments Act which is a state legislation was amended many years ago to attract applicability of the Industrial Employment (Standing Orders) Act 1946

You have to therefore check if the Delhi Shops & Comm. Establishment Act has similar provisions as in case of maharashtra.

However if an organization's manufacturing establishment is covered by the Industrail Employment (Standing Orders) Act, it does not automatically get extended to the organization's establishment anywhere if they are covered under the local Shops & Comm. Establishments Act UNLESS these are also amended as in the case of Maharashtra.

Does this answer your querry? If not, please raise more querries and we will try to answer all.

Dear Malik Ji,
As ur based in Noida, u can help me in my case. Actually I Joined recetly in my presenet organisation which has head office in Delhi and factories in Haryana and Rajasthan.
Factories are covered under respective state Standing order. But Head office is not yet registered due to some reasons. Now there is confusion that Head office will be registered under Delhi shops & Establishment act or factory act 1948.
Please clarify.
