HI
I know it, what problems you are facing, this things are very serious but there is a solution, if the employee is absent for more than 4 days or he/she is not joining on given date wait for 4 days & then send them absconding letter with the terms & condition which are applied by your company & you also need to do cc to the police station which belongs to your city, so employee cant take any legal action against your company.
