Please can anybody let me know the, labour laws applicable to the IT/ ITES company in Karnataka (other than PF, ESI, Leave, Bonus etc). Which works for 24/7? What are the compliance we have to do under the labour law, such as registrations, female employee's working conditions etc.
Ok. Let me be more specific on the query...

I understand that, If any IT/ ITES co employing more than 5 women employees during night shift, co has to apply for the same with LC/ DLC in Form 'R' with the list of men and women employee. LC/ DLC may, grant exemption in form 'S'.

Now the question is,
1. What if only male employees working in night shifts? (Getting exemption is necessary?)
2. What about the Hotel Industry(or other than IT/ ITES), where female receptionist working during night?
3. What are the parameter to register a co as IT/ ITES?

There are List of Acts which is aplicable for IT/ITES sector like Karnataka Shops and Commercial Establishment Act of 1961, Payment of wages Act, Minimum Wages Act, Maternity Benefit Act, Contract Labour(Reagualation & Abolition), Equal Remuneration Act, Gratuity Act Etc....

Under The Karnataka Shops and Commercial Establishment Act of 1961, Employer has to submitt FORM R and DLC will provide FORM S (Exemption for Women Working in Night Shift)

1. There is no exemption necessary for male working in night Shift. The main concern for Exemption for women is given because by this governement can have control on employer to give security for women working in night shift.
2. Yes Hotel is covered under the definition of Commercial Establishment, therefore 5 or more women working in night shift in a hotel needs to have exemption.
3. Nature of Bussiness explains the company falling under IT/ITES sector.
under Labour Law every company has to be registered under Shops and Commercial Establishment Act from Labour Department

My Question is regarding IT/ITES/BPO working of 5 female in a shift as per karnataka Govt. rule. My company is divided into 4 floor (2 floor in same building, and remain two floors are in different building, now if a lady working in night shift and she is alone in that floor however there are several girls are working in different floor(same building/ different building) is it applicable a policy violation as the lady was force to work on on a floor alone in night shift, I need perfect answer ASAP.
