As a probationer and for a professional approach and follow ethics it is always better to have open discussion with HR & top management - to have good relationship either during or after leaving services - keeping in mind the approach of not following similar attitude in the next place.

It all depends on the clause in the appointment order. If the appointment order mentions that the notice period has to be served during the probation period also, the concerned person has to serve the notice period otherwise not.

If there is no mention in the appointment order as regards the applicability of notice period clause during the probation period, the said clause is open to interpretation and it is most likely that the company may use this clause to its advantage. It would be better to get the clarification for the HR department in this regard.
There is no fixed rule regarding the notice period during probation. It depends upon the policy of each company.
