I would like know about number of Sick leave, Casual leave and earned an employee is eligible by rule in an establishment and about its calculation part and about eligibility criteria

Dear Rajshri,
Much of leave is dependant on the culture you wish to establish in your org....don't only go by the rule. The rule is in place only to ensure a bare minimum standard.
However, we need, in our function, to design creative, individual policies which make sense for the businesses and people we represent.
the rule is : 1 day of paid leave(on pro rata basis) for every month and a provision of 1 day medical leave and 1 day casual leave.
so a total of 36 days. 12 + 12 + 12.
please read books also.

Many companies these days have earned or paid leave. The concept of Sick leave and casual Leave has slowly diminshed.
The earned leave days can be decided by the Managing Authority. Idealy 21 days, 24 days etc.. are what most companies work on.
You can decide your leave requirement as per your companies policy.

quantum of leave depends on many things like whether it is factory or establishment.
if it is establishment than where is the location because every state has its shop and establisment act and it varies from state to state.
as per factories act earn leave is one for every twenty days working.
and casual and sick leave are given as per certified standing orders which generallt 10 sick leave and 7 casual leave.
govt has framed law for minimum which u have to give besides this u can increase as per your choice.

U mentioned abt Factories Act rule of 1 leave for every 20 days which comes to around 19 days of leave per year. so 10 sick leaves n 7 causal leaves (as per standing orders) are included in those leaves???

About this i want to say that all leaves basically depend on company to company. Because every company having their own policies regarding leaves
but most of companies gives totally 30 leaves

Dear Rajshri ji,There is no specific number of leaves for Sick and Causual leaves but Earned Leaves as per factories act concern for adult worker if he works 20 days contineously he will be eligible for 01 day EL.However, according to Shops & Estb,Act is concern it is specifically given state to state.Regarding the leave rules I posted earlier in the cite please go through.Regards,PBS KUMAR

Leaves as per Shops & Est. Act: Casual: 12 Sick Leave: 12 Earned Leave: 15 Eligibility of EL: There should be 240 physical working days in a calender year

in a company which is being governed by SHOPS & ESTABLISHMENT ACT, is there any restriction of the number of CASUAL LEAVE availment. (for a company which is having 9 days casual leave, can an employee avail CL for 3 consecutive days or whether it is restricted to certain rules)
