Dear Friends, I have following doubts in case of a company closure, 1) To claim Provident Fund should we wait for normal 60days or can we apply before completion of 60days. 2) In case of company got closed before completions of 5years will the employees be eligible for Gratuity or not. If they are eligible than on what basis they will get the amount. What will be other monetary benefit employees can get apart from one-month salary and above-mentioned two things. Dear Amith Answers 1. NOrmal Pf claim submission 60 days - Yes 2. Gratuity on closure of the factory where an employee has not completed 5 years. No 3. Benefits on closure 1. One month notice or pay in lieu of notice. 2. 15 days salary for every completed year of service 3. Leave salary if any 4. (Oriental) yes you need to wait for 60 days 2) In case of company got closed before completions of 5years will the employees be eligible for Gratuity or not. If they are eligible than on what basis they will get the amount.(oriental) no this is claimable only after the completion of 5 years orf continous service with certain exceptions on account of sickeness etc. What will be other monetary benefit employees can get apart from one-month salary and above-mentioned two things. dear as company has not completed 5 years so no one is eligible for gratuity. if management has not taken permission for closure from labour dept closed suddenly than they have to pay three month salary in lieu of notice pay .you can refer section 25 of ID act .15 days salary also be paid for completing one year service tks j s malik
