Hi friends
One of my friend is working in a reputed company which has not paid the PF contribution of employees since last 15 months (inspite of deducting).
What are the consequences of this ?

Non remittance of employees share of contribution is a serious negligence on the part of employer. The employer will be prosecuted for the offence of mis appropriation of funds as he has deducted the sum from the salary of the employees and not remitted to the EPFO's account. The person responsible for payment of wages shall be sentensed to imprisonment also. The amount due including the interest and damages will be determined following the provisions (section 7A, 7 Q and 14 B)of the Employees Provident Fund and Miscellaneous Provisions Act, 1952. The same shall be recovered as arrears of land revenue.
Once a warrant of arrest is issued by the Enforcement Officer, payment of the amount in a latter date will not lead to escape the arrest since the warrant is for non payment of dues in time ( every month by 15th).
it is a serious offence ,you can give them in writing to PF dept by mentioning them.however any person affected also can file a FIR it come under criminal breach
of trust under section 407 0f IPC.

Hi Balraj here,
regarding the problem of non-payment you can approach the PF office as to how long the company has been remitting the amount. If they are not remitting your deductions, then you are not getting your due. Check with the PF office and once you find any discrepensies you can go for legal details.
