Do not worry. Do not be tensed. It is not a matter of right or wrong. The real challenge is how you are facing this. Even though you are gulity ( Your not in reality) do not show panicked. Int his situation you should talk politely and clearly. For this you should analyse the situation from the day of begining. Write all happenings in sequence. Think and think and write down. Then collate it. Certianly you will get the loophole. Catch it. Consult with a crook lawyer or brilliant consultant. Give your papers to them. Or if you are an orator or an articulte, very fine. discus with your employer. Make them to fall in the loop hole. Accompany with your lawyer to the Head of HR to study the situation to fianlise.

See, No one can prevent anyone from working or running business. They can not circulate about your credential all S/W companies. It will diminsh their image.

Even if your the biggest IT company in India, it cannot foreclose youe career graph; No one can stop you if you have gained knowlege, experinece and courage to go ahead; bitter experience always help but only in future; why don't you think to black list that company in the minds of those potential candidates to that company so that they will not be victims like you and to word to the market not to approach this company for product and solutions; note that there are good customers in this world who look for solutions only from those companies which treat its country, its people, environement better and not alone cost, after sale service or price, etc. You have options to make your name whitelisted and to fight directly aganist your company which may involve huge cost and effort from your part and may impair your career in the sense that you have to pay attention to these things, find more time to spare on this issue, impair your mobility to join in other company in a distant place, etc., Please know that this world is too big and the company even if it is the biggest corporate giant is nothing more than a mustard. It is the mindset of people of the organisation and its management that makes it bigger and not size and turnover. Never give a writing to your company that you have done something, let them give a writing to you, even if it is a notice indicating termination nothing impair your growth if you have the mindset to grow.

Hello,
First lets put things straight. Indian companies threaten employees under the name of "blacklisting" them, so that they cannot get a job in the future. However, you leave a company, short notice, absconding, insubordination, whatever, the employer CANNOT blacklist you from future employment.

If the employee finds out that a particular employer is preventing an employee from future employment, he can sue the employer for an ungodly sum of money in court and WIN!! The employer will have to go to the streets.

So, don't ever, ever think about blacklisting an employee. Things don't work that way, what you see as unfair, will not be unfair to everybody. If an employee disappears, absconds from your organization, think about what you can do to decrease attrition rates, instead of taking unlawful shortcuts. That is the correct route.

Please don't get caught in a class action lawsuit. It will be very detrimental to the company, to your life, since the chairman will first rip you - the HR, apart, and the 1000s of employees working under it.

Blacklist in your own company. Don't try to find a way to write a blacklist which prevents an employee from joining other companies. If you do the latter, you are unlawful and will pay a heavy price if the employee sues you.

may i know if a co. can blacklist me on the grounds that i want to leave as i am not interested in continuing. i never have had any bad records in the past ever. infact i developed medical problems also after working in it. instead of any compensation they want to blacklist me. Please answer me quickly as i have to submit the full and final papers today.

Dude, nobody can blacklist you from employment other than the company which you are leaving. If you find out that they are blacklisting you in other companies as well, sue them for libel/defamation. Don't go idle, Indian's are cowards and the IT services companies in India are taking advantage of this. Don't be a coward and stand for your rights of human employment by suing them using ninja attorneys.
Apart from that, if you are blacklisted for fake experience, and you have been faking your experience, then... ahem... Companies in India internally maintain a blacklist, which they share with other companies. You will have to accept that you will not be recruited by a significant number of companies in the future.
