We have two different companies (X & Y) under single MD and Joint MD(Brothers). Due to personal problems the company has seperated. Now some of the X company employees have shifted to Y company. Now previously worked X company employees are not ready to transfer the PF amount and they have to withdraw the same. When Y company approached the X company to put the signature on the withdrawal forms, they are refusing . Now guide me how to withdraw the PF amount without the signature of the previous employer?

Dear Kruthirang ji,Some more clarification required. Weather the two companies board of directors are same ? In such case the power of Authorised signatory will not be changed. Until the authorised signatory is not changed with RPF Office any one of the suthorised signatory can signed on withdraw form. Insted of withdraw transfer of the PF accumlation is better and advisable.Regards,PBS KUMAR

Dear Why you are worring. For Transfer,if your organisation is not having PF Trust or you are submitting contribution to directly to PF Office, you fill-up form no.13 and submit to the PF office thr your present employer for transfer. It is the duty of the PF office to get the amopunt transferred in your new PF Account. If you wish to withdraw, you need not to go to your present employer. Pl fill up Form No.19 and see the instructions on the form where it is mentioned who are the gazetted officer who can sign the form 19 after getting the signature, pl submit to PF office. Pl confirm that retuns 12 and form 3A have been submitted to the PF office of the last accounting year. You can also enclose a letter with the form 19 that your present employer has refused to sign this form. It will be the duty of the local PF commissioner to get your case settled ak malhotra
