Dear all
i need your suggestion that i have resigned from my previous company on 19 july 2008.but i have not yet recieved my relieving letter and salary.kindly suggest what should i do .coz many times i have called to them and mailed.and before 1 week i have send a letter by speed post but they did the same didn't gave any feed back..plz reply

Dear neetu if u have given resignation and relieved properly company should give u salary and relieving letter.if this is the condtion send them a legal notice. tks j s malik

The salary for the month of july would not be paid to you as you have resigned on 19 july'08.The amount for the number of days you have worked would be paid to you in full and final settlement which will take 45-60days from the date the employees resignation has been uploaded in company records.Relieving letter would be issued only after full and final settlement is made.Meet the concerned HR person and find out when your full and final settlement would be made to get your relieving letter
Please correct me if am wrong.

Dear Nitu

You did not tell any thing about the procedure to be followed in getting the acceptance of your resignation. Generally, in any company the services of any employee can be terminated by either side by giving one month notice or paying salary in lieu of notice. In your case you are telling that you have worked in july and tendered resignation on 19th. Even you did not tell us whether you have worked in the said company after submitting your resignation up to completion of notice period or not. Further in some of the companies it is usual practice to get a service agreement from the employee. In your case it is not cleared whether you have any such agreement with the company or not

In normal course no employer is against for the acceptance of resignation tendered by any of their employee until and unless such employee fails fails to fulfill his obligation towards the company if he is required to do as per the service agreement or appointment order as the case may be.

If you have followed the procedure and fulfill all of your obligations for the acceptance of your resignation then the management has no other way except to accept your resignation and relieving you from their services. If they bluntly refuse to accept your resignation for one or the other reason, then you have to go to your boss in person and tell him the reasons which forced you to tender resignation and request him to accept your resignation. If there is no positive response from him, then you need not worry about it and leave the company services by sending them one more letter stating that you are no more in the services of their organization since you have already submitted your resignation and ask them to settle your final account at the earliest failing which necessary legal action will be taken against them for recovery of money due to you by way of salary for the days you worked in july etc.

Dear Neetu,
As you have already resigned from the company, you will not get the Salary, but will be paid to you as Full and Final settlement. This full and Final settlement will take atleast a month.
After the full and final settement is done, you will be getting the relieving and service certificate.
However, as a practice, the company should give you a Resignation Accpetance letter, stating that the resignation has been accepted and the Releiving letter will be handed over to you after F&F.
