Hi, I would like to know more about Maternity policy. More clarity on what is entitlement and what is not under MP and how it will be considered? Can anyone help me in this? Are there any instances where the documents will not be approved by the Insurance Companies?If so what are the documents we need to collect from the employees ? and is it necessary to include such details in the policy? Hey Pushpa, I am pasting u our Maternity Policy which we follow in our organization.. a. No women employee shall be entitled for the Maternity Leave unlessshe has actually worked for a period of 180 days in the 12 months immediately preceding the date of her expected delivery.( but then Women employee who have worked for less than the period required the Maternity Leave will be calculated on a pro rata basis) b. Female Staff Members are eligible for 3 calendar months Maternity Leave for the first two occasions of confinement. c. The Staff Member may utilize her leave balance in order to extend the duration of leave, if required. d. If the Staff Member is required to extend her leave further on account of post-natal complications, the approval of the concerned Head of the Department is required. However, such leave will be as per guidelines set out below: - Special Maternity Leave for first 3 months on half pay - Special Maternity Leave beyond 3 months on leave without pay e. Maternity leave can be granted for a maximum of two deliveries only to confirmed and married female employees. Maternity leave shall not be granted for deliveries after the second living child. Hope it would be useful for you. As for as the insurance policy concerns its totally depend on the policy whether the Pregnancy charges are covered. But most of the insurance companies are not covering pregnancy.. Details regarding the documents required u better contact the vendor with which u deal with insurance policy

Hi Prathima, This is an useful information on MP and can be considered as ready reckoner for maternity leave policy. Thanks for your inputs... I would also like to have some clarity on one issue, as whether the new consideration on maternity leave which as per my understanding, Government is planning for the extension from 3 months to 6 months... have been implemented or not or is still under consideration... Because few days back we have it in the newspaper about this policy... Please if anyone in the forum can help me out....

Dear Pratima, I think the eligibility for maternity benefit under the Maternity Benefit Act, 1961 is not 180 days of work but 160 days in the 12 months preceding the date of delivery. Similarly the maternity leave is not 3 months but it is 12 weeks. If you take it as 3 months it will account for 90 days or more but in weeks it will come to 84 days only. Regards, Madhu.T.K

Hi Thanks Madhu for the info.. Kanika... As far as my knowledge it is still not implemented.. I dont think so it can even be implemented in Private concern fro 6 months of maternity leave then no employer will hire a female employee as it would be a big loss for the employer. Till date it is only as madhu said only 12 weeks of maternity leave is allowed.

I Think This Act Was Provided For Who's Go To Pregenency Before 12weeks &after 12 Weeks.also Provide Another 1month Leave After Complition Of Total Days,because She Is Going Under Some Operation Like Tubecatmy.

Total leave applicable is 12 weeks which can be availed as 6 weeks prior to delivery and 6 weeks after delivery. However, it is not mandatory that the woman should avail it as 6 + 6 but she can avail the entire 12 weeks after child birth. In case of miscarriage she is eligible for 6 weeks leave. As Prasad put in there is a provision (u/s 10 of the Act) to provide one month leave for illness arising out of child birth, premature delivery etc on production of proof thereabout. Maternity Leave

  • Further 4 weeks paid leave can be availed in case of complication in delivery. This can be in running days also. An employee needs to apply for this leave separately stating the reason of complication in delivery supported by medical documents.
  • 4 weeks leave without pay can be availed for childcare. This can be in running days also. An employee needs to apply for this leave separately.
  • In case of miscarriage, 6 weeks paid leave immediately after miscarriage can be availed, after submitting medical certificate.

Entitlement for Maternity Leave Any women employee who have completed minimum of 80 days of service with the organisation from which she is claiming the maternity benefit, is eligible to get Maternity Benefit under the Act. Maternity Leave

Procedure to complete to avail the benefit under the act from ESIC
  • Employee needs to obtain form no 20 and 21 from local ESIC Hospital.
  • Submit the copy of form no 20 and 21 to ESIC office Also, require to submit one copy of Form no 20 and 21 at Office to HR Department
  • It is not necessary that delivery should take place at ESIC Hospital only. It is up on the choice of employee to consult any hospital for the said purpose.
  • After delivery within thirty days, needs to obtain Form no. 23 from Local ESIC Hospital. To obtain from No. 23, it is compulsory to have Birth Certificate of newly born child.
  • Submit the copy of Form No. 23 to ESIC office. submit one copy at Office to HR Department
Payment of Salary during Maternity Leave Payment of Maternity leave will be, made by ESIC after submitting the Form No. 20, 21 and Form No. 23.
