Dear All,
One of my friend working in a private concern for 1.5 yrs and she got offer in another company with good offer and position, but she has to join immediately.Here the problem starts from the current Company.
In current company : They doesnt accept her resignation and they inform her to stay fro 2 months.but sshe already informed to theem that she cant stay for 2 month due to that she will pay 2 month salrys.
eventhough they were not allowing her to do any process and they very stuborn to stay for 2 month.
The company which she got offer has to join immediately.
what we can do for this.....
pls help me out . i need to help her

Hi...Graceful exit at times is tough from immature organisations.when generally organisations ask for resignation is to avoid cases for dual employment.Ask her to send resignation to his HR manager and mark a CC to himself.Accepting or not accepting is their Problem.It will act as a self declaration that he has resigned from his present organisation.....If the organisation she is planning to join is mature enough they will understand and accept her.This is the prevelent norm in my organisation too......Please let me know your views..Regards.Bishwajeet
No organization has a right to stop the employee from leaving. Check what has been mentioned in ur offer letter for not serving the notice period. If they have mentioned that you have to pay the money then do that and say good bye to them.
As bishwajeet rightly mentioned mark a CC to himself and forward the same to ur future employer.
If they hold ur PF and stuff then u have full right to sue them. No organization will go to that extent since it will only spoil the good will of the company. Do not fail to get ur releaving letter at any cost. It is necessary for your future employers.

Hi Viji,

If the current company rules permit paying salary in lieu of notice your friend can rightfully submit her resignation mentioning that she is willing to forego salary equivalent to the notice period. Let her request for settlement of her dues and also to mention the date upto which she would work with the company. She can also request a relieving letter and experience certificate to be issued.

Since your friend has worked for 1.5 yrs it is worthwhile for her to make an effort through any superior in the company who can convince the HR people in her favour. It is always better if things are amicably settled while leaving a company.

If this is not possible, since the current employer is obviously keen on delaying the process, advise your friend to talk to the new employer and explain that she may not get her relieving letter and experience certificate immediately. If they are willing to allow her to join subject to production of these two documents at a later date she can do so.

It is advisable to take an acknowledgement for the resignation letter from the current employer to ensure that she can rightfully demand the required documents and settlement amounts subsequently.

Thanks to bishwajeet, pratima & Jyoti..
I will advice her to a send mail to HR Manager & her head.
But main problem her boss is so adamant and he is not allowing her to talk, if she comes to meet him - he move away from his place. It’s really new for me to seeing this kind of organization. The company which she going to join they need experince certificate & relieving order and without proper relieving they will not allow her to join. In the current employment they didn’t mention about paying salary in lieu of notice in the appointment letter but her friend left company by paying 2 months salary. so i will ask her to send mail to their HR superior and put CC to him and lets see what they were replying to that mail....

Dear Viji,
Two things to be done..
1. send resignation by mail to head HR marking a copy to self
2. send a hard copy of resignation letter by registered post. (this becomes a legal proof that it has been submitted to your current employer. even they will be aware of that)
after this, aproach the HR head.

Hi viji,
Check with your current company company secretary regarding the notice period if he is your friend surely he will help you. If you have attendance your notice period can be deducted in that. To get the PF no one has the right to stop, becasue all the 24% will be in Pf office you can claim the amount whenever you need. Best of luck for your new company

If she completed her 1 month notice period ,then she can proceed wth general manager directly regarding this issue wth any hire official support or alone.but if she is not completed her notice period then previous mail will suggest you for further proceeding.

Some org. will be like this, at the time of relieving they will create the trouble. my firstsuggestion is, as per others' advice, u just go thr. an influenced person form HR dept. or closer to ur boss.
i got it by ur words, the main pb. is from ur boss itself, if he gives green signal every thing moves out for u easily. so ask him clearly any responsbilities or targets to be completed. if he assigns something, try to complete that task. meanwhile u should trap ur new company HR people by clearly stating the conditions from ur side, so that u couldn't lose that opportunity.
But as per my idea no company do like this, means after paying 2 months salary they should relieve compulsory. from the company the demand should be by work wise or money(sal) wise but nothinh is working out in ur case.
you just get the info. of the candidates who relieved earlier in the past 6 months about anybody got the pb. like this? just enquire, there may be a hidden solution. discuss with your collegues about ur pb. and find out the possibility.
