Dear All, Can anyone tell me if the Consultants or Interns in an Organisation need to contribute for ESI and PF? Is there any rule regarding this?
Any payment in which 'labour' is involved will attract ESI and PF. Interns are trainees appointed for a limited period and they are treated as trainees. Only trade apprentices engaged as per Apprentice Act are exempted from ESI, though there is supreme court verdict to excempt all trainees from PF. Interns will also come under trainees appointed following the Standing Orders of the company and ,therefore, will be covered by ESI. Consultants are also covered provided they receive honorarium on monthly basis. There are different view points raised on this matter like Chartered Accountants fees etc which are ofcourse paid not monthly.
