Fixing of minimum wages for dispatch assistant in up office having their company head office in bangalore
Dear colleagues we have taken a person in the grade of office boy for our lucknow depot. our head office is based at bangalore and we are processing salaries/wages from head office including payment of pf and esi contribution to concerned authorities. according to karnataka minimum wages i have go fix his wages rs.11300/ and according to up minimum wages i have go fix his wages at rs.7400/. i request you to share your views as to whether i should fix up wages or karnataka wages while issuing his appointment letter. can you please share your firm opinion on this so that it will be of great guidance and help for me.

Dear experts it has been observed that in spite of minimum wages rules and regulations by the state authorities and by the central authorities meaning companies do not provide wages as per minimum wages act. i found in many companies the salaries are far below than the minimum wages prescribed in the notification. my questions are: 1. is it compulsory to pay minimum wages as prescribed since many companies are not following it in practice? 2. the minimum wages prescribed in the notification are basic or gross salary? 3. do minimum wages change as per the skill level of employees? 4. many small companies do not afford to pay the salaries as per minimum wages act. so how much company should face this problem? kindest regards

In the case of heavyduty drivers outsourced to a logistics company whether the salaries and wages should be payable under the scope of minimum wages applicable under the classification of motor vehicles sector or it should be paid under the shops and establishment act since the logistics back office is registered under the shops and establishments act.

Pls help to clarify "whether basic salaries and gross salaries can be the same" if we consider basic salary as per minimum wages. telangana minimum wages rs 335/day so total in 26 days rs 8710 if i pay basic salary rs 8710 we have to pay 12 pf of that amount and 1.75 esi . i have not pay hra & other allowances is it compliance or not ?? pls confirm.
Recovery from unclaimed wages
Dear seniors & colleagues just would like to take your view on the below situation: unclaimed salaries/bonus are lying with us in the company for those employees who all are either absconding or left the job without notice period. we have held their salaries for 1 month at that time and in their full & final settlement recoveries occured may be because of wage for bulk attendance or for ntice period. recoveries are on higher side than the wages to be paid and we have sent letters to these employees to pay us this recovery but they never turned up and amount are lying unclaimed. please advise can we recover this amount of recovery from this unclaimed salaries? or else whether we have to deposit this amount to labour welfare fund? please advise. regards ranjeet
