Dear all Seniors,
I've got an offer from one of the leading Infastructure/Construction Co. in NCR and acceptinng the offer i've decided to join them soon.
Currently i'm with a medium size manufacturing Company and dont know much about the laws applicable to construction industry.
Kindly advise what specific diffrences (in preview of Statutory Laws and rules) are there ? Are there any special laws applied to these industry or are same as the manufacturing ones.
Kindly Help me to get myself prepared for this opportunity.

Dear Rahul,
As requested by you,Previously you were i mnfg co its come under Factories Act,but construction co., come under service industry,you may mainly concentrate on CLA.remaining acts are same,bur few register to be maintain shops act.

I understand From ur reply that Service Industry / Construction Industry Comes Under Preview of Shop & Establishment Act and People Involved would be more of Contract Employees.
Can u pls. explain it a little more Like what are the Registers/Documents/Important Licences to be obtained from The authorities and what would be core activity of a HR/Personnel Employee in this kind of Industry.

The construction industry comes under the service catogery. The taxes covered to this industry is follows,

1. Income tax as per the Registration of the firm,
2. Value added Tax at present 2% undre compossition scheme. You may use input & out pur tax credit faciliy. I think use the first option is better. Vat system is self assessment basis

3. service tax is the levy introduced by the govet on 10.09.2004 at the rate of 10% tax & education cess 2 % to st value. At present the Tax rate is 12% and 3% of Education cess to the gross amount charged value. The gross amount charged is includes the materials which is supplied by the service receiver at free of cost. The service provider is responsible for paying service tax wether the tax is received from the service receiver or not.

The informations you need is very large. I give a very small. If you need to know more about the Taxation of construction industry, go the nearest book shop and find a book in the name of "taxation of construction industry" and read it fully

Dear Rahul
It is the Building and Other Constructions Welfare Act (BOCW Act) which u must be aware of, and got registration under it, n have to pay 1% cess on total cost of construction.
If u r engaging contract labours, which u obviously do, then Contract Labour Act also applies and u have to take license under it.

Sub: Construction & Real Estate Companies – Employees Service Benefits.

Construction & Real Estate Companies (5 to 6 Firms under 2-3 Directors) with 40 employees posted in different Cos. were working since 4-5 yrs. without formalizing their relationship of Master & Servant by issuing Apptt. Orders etc., No HR Dept., No Personal Files. Employees are worried about their Service, Seniority, Benefits etc., since Company used to transfer them from one Co. to another due to less work or closure of Project of one Co. in one location to another Co. / location leading to employees not having continuous service in one Co.

Now, the Management wants to formalize by issuing Appt. Orders. Can different Firms join to form Pvt. Cos. & issue Apptt. orders after settling all dues ?

What is the best course of action for the Management under such situation ?. Though 5 yrs. lapsed, as the employees were working under different Cos., can they ask for continuity of service & service benefits ? Company now wants to convert individual firms into 2-3 different Pvt. Cos. Can the Company ask all employees to resign, collect settlement & then issue fresh Appt. orders. Since there is no Apptt. Orders issued, whether Notice to be issued to all; to terminate their service in the first instance ?

Request Sr.CiteHR Members to give their valuable advices/ guidance & solutions in such situations to overcome any legal problem in future. Please give any previous cases in such Construction & Real Estate Cos., since there are many small small Firms which are now Estd.,well to do and wants to solve theirs as well as employees problems. This will help to solve the problems of not only the Management, employees but also for Managers & Consultants working for such Companies.
