Hi,

As I have got new job in new company & they asking me to join asap.

So I had submit my resigination mail to my manager . & given the notice period of 20 days . but my manager replied in mail that i have to serve two months notice period. & i had discussed with SPM/PM ,that i have no such resposibilites as i am project buffer resource. so pls releave me in 20 days & rest 40 days period u can buy the same. but they were not agree & after that manager replied me that your resignation has been accepted & LWD mentioned in the same( ie. serve full 2 month notice period). & now liitle bit confuse what should i do.

1. New employer is agree to join on that date without any releaving letter & i have show last two month salary slip.& they are giving me the joining bonus also.

2.Pls tell me if i left the company without any formalities right now & will the company do the full & final settelment later on.(LTA+Medical all is pending)

& company will do any legal action if i not serve the notice period. & following terms are mentioned in this.

*****Employment with the Company will stand terminated at the end of the financial year in which you attain the age of superannuation (60 years). Termination of employment may also be initiated earlier by either party by serving prior written notice on the other, as per the notice period stipulated in this offer. The Company is also entitled to either waive the notice period in part or in full at its sole discretion or require payment of equivalent base
salary in lieu of the unserved notice period. The Company further reserves the right to terminate with sooner effect by tendering equivalent base salary in lieu of the notice period

**** In the event of termination of services by either party, the applicable notice period will be Two months.

In the event of your serving on the company a notice of termination of employment by submitting a resignation letter, your release will be governed by the General Terms and Conditions of Employment in force at that point in time, subject to the satisfactory handing over of your duties, responsibilities, Company documents, Company assets, etc. to the relevant parties.

2. I have completed 13 month in present company & tottal exp is around 5.6 years. & this is my third company.& new employer will not extend the DOJ more than 7 days given by them. & tottal notice period i am giving is around 20-25 days. & also i have 22 leaves

Pls guide me . Should i go to HR for further discussion.? & what should i discussed more.

Dear Luck123,
Kindly read your appointment letter what is mentioned in it about resignation.
If it is mentioned that you have to give 2 months notice or 2 months salary in lieu of notice period, talk to your current employee to buy your notice period. Same time discuss with your current Head about your new assignment and request him to relieve you with the time frame required by you.
If they are not aggree ask them to deduct the salary in lieu of notice period while doing the full and final settlement.
It is not advisable to join a new company with completing your full and final settlement formalities form the current company.
In future if you require the relieving letter of this compnay you will be in trouble.

in this case you can join new company and they may not ask relieving letter but when u will join another company than u may require it.i feel u make your full and final and let them deduct forty days salary as u are already serving 20 days.
